When a deal is made to build a major international storage dam, the Secretary of State, through the U.S. Commissioner of the International Boundary and Water Commission, may agree with Mexican officials under Article 7 of the February 3, 1944 treaty to build, operate, and maintain the United States’ share of hydroelectric facilities on a self‑liquidating (self‑paying) basis. If separate U.S. power facilities are agreed, the U.S. Commissioner must build, operate, and maintain those self‑liquidating facilities.
