The Secretary of State can, through the U.S. Commissioner of the International Boundary and Water Commission (United States and Mexico), make agreements with Mexico to do emergency flood-control work on the lower Colorado River between Imperial Dam and the Gulf of California, on both sides of the border. The agreements must cover joint clearing of trees and brush, removing sediment from the channel, and steps to prevent new sediment build-up caused by desilting work at diversion dams. Any proposed agreement that would build or run works in the United States under the Secretary of the Interior’s control must have prior approval from the Secretary of the Interior. These actions are for flood control under article 13 of the 1944 Water Treaty with Mexico and are meant to follow the Memorandum of Understanding dated February 14, 1945, among the Department of State, the U.S. Section of the International Boundary and Water Commission, and the Department of the Interior.
