The Secretary of State can make an agreement with Mexican officials to have the International Boundary and Water Commission operate and maintain the Douglas‑Agua Prieta sanitation project in Douglas, Arizona, and Agua Prieta, Sonora, Mexico, even if other laws would say otherwise, and following the rules in this section and section 277d‑7. The agreement must say how the U.S. and Mexico split the operation and maintenance costs, using the Commission’s recommendation and approval by both governments. The agreement cannot go into effect until the Douglas, Arizona, city government assures the Secretary of State it will pay a fair share of the U.S. costs, as set by the U.S. Section of the Commission and approved by the Secretary of State, for as long as the agreement lasts.
