The Secretary of State, through the U.S. Commissioner of the International Boundary and Water Commission, may make an agreement with the Government of the United Mexican States to build, operate, and maintain a drainage canal in Mexican territory to carry waters of El Morillo and other drains into the Gulf of Mexico, following the plan in the Commission’s minute No. 223 dated November 30, 1965. Mexico and the United States must split construction costs (including design and right‑of‑way) and operation and maintenance costs equally. Before the agreement is signed, the Secretary must get satisfactory promises from private citizens or a responsible local group to pay half of the U.S. share of those costs. Those payments go into the U.S. Treasury as miscellaneous receipts.
