The Secretary of State may lease or sell land the United States got under any Act, Executive order, or treaty that is tied to projects run by the Secretary through the American Commissioner. These actions must follow the rules in chapters 1 through 11 of Title 40 and Division C of Subtitle I of Title 41, except for sections 3302, 3306(f), 3307(e), 3501(b), 3509, 3906, 4104, 4710, and 4711. Public sales must be advertised for thirty days and bring at least the value set by three impartial appraisers chosen by the Secretary. Private sales are allowed but not for less than that appraised value. Land given to the United States that is no longer needed can be returned free to the donor or their heirs. The Secretary can keep rights‑of‑way for irrigation and related uses, require lands be included in nearby irrigation districts, and send sale or lease money to the U.S. Treasury. The Secretary may also give unneeded land at no cost to a bordering State or to local governments for public use. The Secretary can issue revocable licenses and sign leases or deeds for irrigation or other uses that do not conflict with U.S. use. If a project damages private or municipal irrigation, water, sewage, or other property, the Secretary can rebuild or pay the owner a fair amount agreed with the American Commissioner. The Secretary may also pay claims for damage occurring after March 31, 1937, up to $1,000, if the claim is filed within one year and supported by a report from a board appointed by the American Commissioner, using funds for the project.
