Defines key words used to control exports and transfers of missile-related items. Missile: a Category I system under the MTCR Annex, similar unmanned delivery systems, and the special production plants for them. Missile Technology Control Regime (MTCR): the policy announced on April 16, 1987 by the United States, the United Kingdom, the Federal Republic of Germany, France, Italy, Canada, and Japan to limit sensitive missile transfers, plus any later changes. MTCR adherent: a country that takes part in the MTCR or that, under an international understanding with the United States, controls MTCR items using MTCR rules. MTCR Annex: the MTCR Guidelines and the Equipment and Technology Annex and their changes. Missile/MTCR equipment or technology: items listed in category I or category II of the MTCR Annex. United States person: has the meaning used elsewhere in U.S. law. Foreign person: anyone who is not a United States person. Person: a natural person or many kinds of organizations, including government-run businesses and successors; for certain non-market-economy countries (excluding former Warsaw Pact members), it also covers all government activities tied to missile equipment or to electronics, space systems, or military aircraft. Otherwise engaged in the trade of: for a specific export or transfer, being a freight forwarder, designated exporting agent, consignee, or end user. For international understandings made with the United States after January 1, 2000, “international understanding” means either a specific promise by a country not to export MTCR items that would help missiles in a non-adherent country (and would be covered if they were U.S.-origin), or a specific promise that the United States keeps the right to act under this chapter in those cases.
