§3309 Taiwan instrumentality

Title 22 › Chapter CHAPTER 48— - TAIWAN RELATIONS › § 3309

Last updated Apr 6, 2026|Official source

Summary

When the President or a U.S. agency has to do something with Taiwan under U.S. law, they must deal with an agency set up by Taiwan that the President says has the legal power in Taiwan to act for Taiwan. The President is asked to give that Taiwan agency the same number of U.S. offices and staff Taiwan’s government had before January 1, 1979. If Taiwan gives similar protections to the Institute and its staff, the President may give matching privileges and protections to the Taiwan agency and its personnel, with appropriate conditions.
