The Commission must publish a notice in the Federal Register whenever it proposes changes to the Panama Canal measurement rules or toll rates called for in section 3791. The public gets to send written comments and attend a public hearing held at least 30 days after the notice is published. The notice must say what is being proposed and when and where the proceedings will happen. At the time of notice, the Commission must make public an analysis explaining why the change is proposed. For toll changes, that analysis must show how old and new rates meet section 3792 and that the Commission fully considered five factors in Understanding (1) of the Resolution of Ratification of the Treaty Concerning the Permanent Neutrality and Operation of the Panama Canal (adopted by the United States Senate on March 16, 1978), such as Canal operating costs, competition with other transport, protection of domestic fleets, regional effects in both countries, and promoting international trade. After reviewing comments, the Commission can revise its proposal. If a revision raises tolls above an earlier proposal, the Commission must publish a new analysis and a new notice and hold another hearing at least 30 days after that notice. The final change can be made after the procedures above, but the Commission must publish the final notice at least 30 days before the change takes effect. Actions under this part can be reviewed in court under chapter 7 of title 5.
