Inspections in the United States under the Convention must be approved by the U.S. National Authority. Inspectors from the Technical Secretariat can inspect any plant, site, or facility that the Convention allows. The U.S. National Authority picks federal employees to go with the inspection team. For inspections of U.S. government facilities, contractor staff may join but must be led by a federal employee. An FBI special agent chosen by the FBI must accompany each visit, EPA and OSHA employees may not join, and only the smallest number of U.S. representatives needed should attend. The President can block a person from being an inspector if he reasonably believes the person took part in terrorism, committed a U.S. felony, or would threaten national security or the economy. The President’s objections cannot be reviewed by a court. The FBI escort rule does not apply to inspections of U.S. chemical weapons destruction sites as defined by the Convention.
