A country can be named a candidate to get help under section 7704 if two things are true. First, its per-person income in a fiscal year is at or below the World Bank’s yearly cutoff for starting the International Bank for Reconstruction and Development graduation process. Second, the country is not barred from receiving U.S. economic assistance under part I of the Foreign Assistance Act of 1961 (22 U.S.C. 2151 et seq.) or any other law. If the President, the Secretary of State, or another U.S. official uses an allowed waiver or suspension of those laws and notifies Congress as required, that will count as meeting the second condition. The Board decides which countries are candidate countries.
