The President must put people on a list and impose penalties if he finds credible evidence that they are Iranian government officials or acting for that government and were involved in serious human rights abuses against Iranian citizens or their family members on or after June 12, 2009. The President must give that list to the appropriate congressional committees not later than 90 days after July 1, 2010, update it by 270 days after July 1, 2010 and every 180 days after that, and update it whenever new information appears. The list should be unclassified but can have a classified annex. The public part must be posted on the Department of the Treasury and Department of State websites. In making the list, the President must consider credible information from other countries and human rights groups, including those in Iran. The penalties include being denied a U.S. visa and actions under the International Emergency Economic Powers Act, such as blocking property and limiting or banning financial and trade dealings, with rules the President may set. Those rules can include exceptions needed to follow the Agreement between the United Nations and the United States about the U.N. Headquarters (signed June 26, 1947, and in force November 21, 1947) and other international obligations. These measures end only when the President certifies to the appropriate congressional committees that Iran has met four conditions: unconditionally released all political prisoners (including those detained after June 12, 2009); stopped violence, unlawful detention, torture, and abuse of peaceful political actors; carried out a transparent investigation and prosecuted those responsible for the post–June 12, 2009 killings, arrests, and abuse; and publicly committed to and is making clear progress toward an independent judiciary and respect for the rights in the Universal Declaration of Human Rights.
