The Secretary of State must send Congress a report that names people the Secretary finds responsible for serious human rights abuses or censorship in North Korea and explains what they did. The Secretary must consider the United Nations Commission of Inquiry’s findings and must make specific findings about Kim Jong Un and each person who is a member of the National Defense Commission or the Organization and Guidance Department of the Workers’ Party of Korea. The first report is due within 120 days after February 18, 2016, then every 180 days for up to 3 years. The report must be unclassified (it can have a classified annex), be included in the human rights reports required under sections 2151n(d) and 2304(b) of this title, and the unclassified part must be posted on the State Department website. The President must designate under section 9214(a) anyone on the report who knowingly engages in, is responsible for, or helps with censorship or serious human rights abuses by the North Korean government. Congress urges the President to seek a U.N. Security Council resolution to block the assets of all such people and to cooperate with prosecutions before any international tribunal.
