The Secretary can offer a line of credit — a promise to make a loan later — to one or more project borrowers for an approved project. The money can be used only for specific needs: paying debt service for project financing, big repair or replacement costs, operation and maintenance, and costs from unexpected federal or state environmental rules. The loan terms, rules, and checks will be set by the Secretary. Before agreeing, the Secretary must work with the Office of Management and Budget and the rating agencies that gave a preliminary opinion to set a capital reserve subsidy amount. The line can only be funded if the project’s senior debt gets an investment-grade rating from two rating agencies. A line cannot be larger than 33 percent of the project’s expected eligible costs. Each draw from the line becomes a direct loan and can be taken only if the project’s net revenues (including capitalized interest but not required financing reserves) are not enough to cover those allowed costs. Interest must be at least the yield on 30-year U.S. Treasury securities on the signing date, unless specific exceptions apply. The undrawn amount is available for 10 years after the project is substantially complete. Repayments must begin no later than 5 years after that 10-year period ends and must be fully paid within 25 years after that period. The Secretary may charge fees and may limit total federal support so that the line plus any secured loan does not exceed 49 percent of eligible project costs. Under narrow conditions, a public agency borrower may get a waiver of a non‑subordination rule if the line is rated A or higher, the loan is backed by revenues not tied to project performance, and the federal share is 33 percent or less; then the federal credit subsidy is capped at 10 percent of the loan principal and the borrower pays the rest.
