Until a person is moved and released under section 323, the Secretary may provide their care and treatment at any federal hospital, or by agreement at federal hospitals outside the Department, or under contracts or other arrangements (without following section 6101 of title 41) at any public or private hospital in any State. The Secretary can move the person from temporary care under section 322 and must give the patient’s best interests weight when choosing a hospital. This authority does not apply to anyone whose medical care is already the responsibility of another United States agency.
