Before spending money or promising to spend money to plan, design, build, or fix up health facilities under section 13, the Secretary (through the Indian Health Service) must talk with any tribe that will be significantly affected. The goal is to learn and, when possible, honor tribal preferences about size, place, type, and other features of the facility. When possible, new or renovated facilities must meet the Joint Commission on Accreditation of Health Care Organizations’ standards within 1 year after work is finished. A hospital or outpatient facility cannot be closed unless the Secretary gives Congress an evaluation at least 1 year before the planned closure. That evaluation must cover things like access to other care, cost savings, care quality after closing, availability of contract health funds, tribes’ views, how much eligible people use the facility, and the distance to the nearest open Service hospital. Short-term closures for medical, environmental, or safety reasons are allowed. The Secretary must keep a national priority list for health facility needs made with tribes and tribal groups and must give tribal needs the highest priority. Needs for facilities run under tribal contracts or compacts must be treated the same way as Service-run facilities. Not later than 1 year after March 23, 2010, the Secretary had to send Congress a ranked list of all facility needs and the method used, and starting in 2011 must update that list at least every 5 years and include it in the annual report. The Comptroller General must review the priority system within 1 year after it is set and report to Congress and the Secretary. Funds used under section 13 for tribal facilities must follow the Indian Self-Determination Act rules (including section 102 and sections 504–505). The Secretary must also work with tribes and tribal organizations, and consult urban Indian organizations, to try new ways to meet facility needs.
