Title 25 › Chapter CHAPTER 21— - INDIAN CHILD WELFARE › § 1901
Congress declares the United States has a special relationship with Indian tribes and a federal duty to protect them. Under the Constitution and other laws, Congress has full authority over Indian affairs and has taken responsibility for protecting tribes and their resources. Congress also says Indian children are the tribe’s most important resource and the federal government must protect them. Many Indian children are being taken from their families, often without good reason, and placed in non‑Indian homes. State officials often fail to respect tribal ties and tribal culture in custody cases.
