Museums that break the rules in this chapter can be fined by the Secretary of the Interior. The fine is set after an official hearing, and each time a museum violates the rules it can be charged separately. The department’s rules will decide how big a fine can be and must take into account the item's archaeological/historical/commercial value, the harm to the injured party (both money losses and other harm), and how many violations happened. If a museum does not pay a final fine that was not appealed, the Attorney General can sue in federal court to collect it, and the court cannot reexamine the fine’s validity or amount. At hearings, subpoenas can order witnesses and documents to appear, and witnesses get the same fees and travel pay they would receive in U.S. courts.
