Title 25 › Chapter CHAPTER 45A— - OKLAHOMA INDIAN WELFARE › § 5201
The Secretary of the Interior can choose to get land, water rights, or surface rights for Indians by buying them, taking gifts, trading, or other transfers. The land must be good-quality farm or grazing land and the amount must match the needs of the tribe, band, group, or individual for whom it is bought. The United States will own the land in trust for that tribe, group, or person. While the U.S. holds the land in trust it is exempt from all taxes. The State of Oklahoma may still charge a gross-production tax on oil and gas from those lands at no higher rate than it charges private lands, and the Secretary must make sure that tax is paid.
