When a school district with education contracts for Indian students under sections 5342–5348 has a school board that is not mostly Indian, the Indian parents of the enrolled children must elect a local committee from among themselves. That committee helps make and can approve or reject programs run under the contract. The Secretary of the Interior will set the committee’s duties and how it is organized. If an Indian committee or advisory board already existed before January 4, 1975 (see 20 U.S.C. 7424(c)(4) or 25 U.S.C. 5342–5348), the tribe may choose to use it instead. The Secretary of the Interior can cancel a contract if the contractor prevents the local committee from doing its duties.
