The President must include in the annual budget sent to Congress all money needed to fully pay every funding agreement under this law, including money for tribal base budgets. Any money approved goes to the Indian Health Service and is given to the Office of Tribal Self-Governance to hand out under the rules in section 5385. The Indian Health Service cannot cut a self-governance tribe’s guaranteed funding, even if the money goes through that Office. The budget must also list, for each tribe, how much of its need is currently paid and any shortfall in funding. This must cover direct program costs and contract support costs for services done by the Secretary of Health and Human Services, by self-determination contracts, or by compacts and funding agreements under this law.
