Imposes taxes when advice or agreement causes a donor-advised fund distribution that gives a more-than-incidental benefit to certain covered people. Anyone who advises the distribution or who gets the benefit pays a tax equal to 125% of the benefit. A fund manager who agrees to the distribution, knowing it will give that benefit, pays 10% of the benefit, capped at $10,000 per distribution. Multiple people can be held fully responsible. No tax applies here if a tax was already charged under section 4958. Covered people: those listed in section 4958(f)(7) for donor-advised funds.
