You must apply for a permit before you start business as a manufacturer or importer of tobacco products or processed tobacco, or as an export warehouse proprietor. You must also apply at any other time the Secretary requires. The application must be on the form the Secretary gives and must answer the form’s questions truthfully and accurately. The Secretary can reject the application and deny the permit after notice and a chance for a hearing if the Secretary finds any of these: (1) the business location is not adequate to protect the government’s revenue; (2) the planned activity does not meet minimum capacity or activity rules the Secretary sets; or (3) the person (including corporate officers, directors, major stockholders, or partners) is not likely to follow the rules because of business experience, finances, trade ties, or past or current federal felony cases about tobacco, has been convicted of a related felony under federal or state law, or failed to give required information or gave a material false statement on the application.
