When the government gets money from seizing, taking under section 6332 (except under subsection (d)(2)), selling property, or selling property it redeemed where it had a tax lien, the money must be used in a specific order. First, pay the costs of the seizure or sale. Next, if the property had unpaid tax, pay that tax; if the tax was not already assessed, it will be assessed then. Any money left goes to the tax debt the levy was for. If there is still extra money after those steps, the Secretary must return it to whoever is legally entitled to it if they apply and show proof.
