Within 90 days after the Human Rights Enforcement Act of 2009 was passed, the Attorney General must create a unit inside the Justice Department’s Criminal Division to enforce laws against people suspected of serious human rights offenses. The unit can take legal action, must work with the U.S. Attorney in the area, and should consult the Secretary of Homeland Security and the Secretary of State. It must consider whether the United States or a foreign country is able and willing to prosecute the same conduct. “Serious human rights offenses” means federal crimes like genocide, torture, war crimes, and using or recruiting child soldiers (18 U.S.C. 1091, 2340, 2340A, 2441, 2442).
