Full-time magistrate judges must have the actual, necessary costs of doing their jobs paid. That can include pay for needed legal and clerical staff. The Director pays these costs under rules the Judicial Conference approves. The Administrator of General Services must give them courtrooms, offices, furniture, and facilities in federal buildings. If no suitable space exists, the Administrator can get and pay for space elsewhere but only if the Director asks and the circuit’s judicial council agrees. Part-time magistrate judges can be reimbursed for actual job-related expenses under Director rules that the Judicial Conference approves. Reimbursed items may include staff help, supplies, phone and communications, travel, and other necessary costs. Reimbursement cannot pay for buying or renting office space.
