The Administrator must approve state plans that follow the rules and must reject plans that do not. Before rejecting a plan, the Administrator must tell the State and give it fair notice and a chance for a hearing. Two specific rules from section 727(c) and (d) also apply to these plans, but with three name swaps: where those rules say "Secretary" or "Commissioner" they mean the Administrator; where they say "State agency" they mean the designated State entity; and where they point to section 721 they mean section 796c. Not later than 1 year after July 22, 2014, the Administrator must publish minimum compliance indicators for centers for independent living and for Statewide Independent Living Councils. Each year the Administrator must do onsite checks of at least 15 percent of the centers that get funds under section 796f–1 and must review every center from time to time. Each year the Administrator must also inspect at least one‑third of the designated State units that get money under section 796f–2, and when needed must inspect centers in that State to check compliance with subsections (f) and (g) of section 796f–2. Reviews should use HHS staff who know independent living services, the supervisor must have that knowledge, and at least one reviewer must be a non‑government person with center operation experience. The Director named in section 796–1 must give the Administrator information, and the Administrator must include in an annual public report how centers followed the standards in section 796f–4. The report may name individual centers and must include the onsite review results and be made public quickly, including online.
