The Secretary may make rules, after public comment, that let the fund pay incentives to encourage remining of eligible land under section 1234. The rules must say incentives apply only if the Secretary and the State regulatory authority (under subchapter V) agree that the land would probably not be remined and reclaimed without them. Examples of incentives include rebates or waivers of reclamation fees under section 1232(a) and using fund money to provide financial assurance instead of all or part of the performance bonds in section 1259. Rebates may only pay for removing or reprocessing abandoned coal mine waste or for remining work that meets the priorities in section 1233(a)(1) or (2), and any rebate cannot exceed the estimated cost to reclaim the land.
