When someone applies for a coal mining permit under a State or Federal program, they must include a reclamation plan that shows the land can be restored as required. The plan must identify the lands to be mined and the size, order, and timing of the areas to be mined. It must describe the land’s condition before mining, including existing uses, soil and foundation traits, topography, vegetation, and productivity (including prime farmland and crop yields), and include a soil survey if applicable under section 1257(b)(16). The plan must say what the land will be used for after reclamation, explain how that use will be reached, and include comments from the surface owner and relevant state or local officials. It must describe mining and reclamation methods and major equipment, plans for surface water control, backfilling, soil reconstruction and stabilization (including the soil work required by section 1265(b)(7)(A)–(D)), revegetation, and an estimated cost per acre plus how the operator will meet the requirements of section 1265. The plan must show efforts to maximize recovery of the fuel resource, give a detailed timetable for major steps, explain how operations fit with owner and local or state land use plans, list steps to meet air, water, health, and safety laws, account for local physical and climate conditions, list lands or land interests contiguous to the permit area, provide test borings or similar data (including subsurface water locations and chemical analysis of mineral and overburden), and describe measures to protect water quality, water quantity, and the rights of water users or to provide alternate water if needed. The regulatory authority may also require other items. Any information in the plan that is not public under State law must be kept confidential by the regulatory authority.
