The Secretary must make rules about how underground coal mining affects the land and surface. The rules must follow the rulemaking steps in section 1251, take into account the clear differences between surface and underground mining, not conflict with the Federal Coal Mine Health and Safety Act of 1969, and cannot be issued until the head of the department that runs that Act gives written agreement. Every permit for underground coal mining must force the operator to meet 12 kinds of protections, including using known technology to avoid or control ground sinking (while allowing planned subsidence when needed and not banning standard room-and-pillar mining); sealing portals and other openings no longer needed; filling exploratory holes and returning wastes to mines when feasible; stabilizing and designing surface waste piles and dams under the standards in section 1265(f); keeping or creating a lasting, diverse plant cover similar to the natural area; protecting offsite areas; removing fire and health hazards; protecting water by avoiding or treating acid or toxic drainage, casing boreholes, and minimizing added suspended solids and channel changes; following standards for roads and other surface impacts but adjusted for underground mining; minimizing harm to fish and wildlife using the best available technology; and siting new drift openings to prevent gravity drainage from acid- or iron-producing seams. Regulators must suspend underground mining under cities, towns, or near major buildings, impoundments, or permanent streams if there is imminent danger to people. The normal rules about permits, bonds, inspections, public review, and appeals apply to surface work from underground mines, with necessary changes made under section 1251.
