Since fiscal year 1992, the Secretary of the Interior or a designee may make cooperative agreements with States or Indian tribes to share royalty information and help with compliance work (inspections, audits, investigations, enforcement), but not to collect royalties, civil penalties, or other payments. If a State asks in writing, the Secretary may also delegate leasing audit, inspection, and investigation powers to that State. Agreements or delegations cannot cover Indian lands without the tribe’s permission.
