The Interior Secretary can give someone the right to buy up to five acres for a home if a land transfer would be okay but the required consent wasn’t given. He must follow his own rules. The land must come from certain federal public lands. The buyer must make plans the Secretary approves to leave their unpatented mining claim and pay for any unauthorized use. The right expires five years after it’s granted. The price is set under section 705. If the transfer does not give full ownership, it must allow the person to remove their buildings or other property when the term ends, or within one year after the person’s death.
