After an inspection, the Secretary must mail an operator a citation and a proposed fine by certified mail and send a copy to the miners’ representative. The operator has 30 days to tell the Secretary he wants to contest the citation or the fine. If no one contests within 30 days, the citation and proposed fine become a final Commission order and cannot be reviewed by a court or agency. Refusing to accept the certified mail still counts as getting it. If an operator did not fix a violation in time, the Secretary must mail a notice and proposed penalty and give 30 days to contest. When deciding that penalty, the Secretary must consider the operator’s past violations, business size, negligence, effect on the business, how serious the violation was, and any good-faith efforts to comply. An operator may ask the Commission for temporary relief from an order if there was a hearing, the operator likely will win, and miners’ health and safety won’t be harmed. Workers may not be fired or punished for reporting dangers, joining proceedings, or getting medical checks. A worker or miner representative has 60 days to file a discrimination complaint with the Secretary. The Secretary must send a copy to the employer and start investigating within 15 days. If the complaint is not frivolous, the Commission can order immediate reinstatement while the case is decided. The Secretary must tell the complainant the investigation result within 90 days. If the Secretary finds no violation, the worker has 30 days to take the case to the Commission. If the employer or miner contests a citation, order, penalty, or abatement time within 30 days, the Secretary tells the Commission, which must hold a hearing and issue a final order (usually final after 30 days) and speed the case along.
