The Secretary of Labor and the Secretary of Health and Human Services can write rules they think are needed to carry out this subchapter. Those rules must follow the rulemaking process in section 553 of title 5, even if subsection (a) of that section would suggest otherwise. At the end of fiscal year 2003 and each year after, the Secretary of Labor must send Congress an annual report about the topics in this part and part B. Each report must meet the submission rules in section 942 of title 33. Operators must still follow any state workers’ compensation law unless that state law conflicts with this subchapter and the Secretary makes a different rule. State laws that give larger benefits than this subchapter are not treated as conflicting.
