Agencies must check certain databases before they give out any federal money or awards. They must look at Social Security death records, the General Services Administration exclusion list (System for Award Management), the Treasury Debt Check, HUD’s credit alert systems, the HHS Office of Inspector General exclusion list, and Social Security’s records on incarcerated people (sections 202(x) and 1611(e) of the Social Security Act (42 U.S.C. 402(x), 1382(e))). The checks are done through the Do Not Pay Initiative, which also can use other databases the Director of the Office of Management and Budget (OMB) picks. OMB must pick databases that help stop wrong payments and give public notice and a chance to comment first. States, state contractors, and the judicial and legislative branches can use Do Not Pay under privacy rules OMB sets. Agencies must still make a payment if the law requires it even when a match flags a problem. The earlier “working system” required by law continues and each agency must review all payments through it. Agencies may make ongoing computer-matching agreements under the Privacy Act, and a Data Integrity Board must answer proposals within 60 days. Such agreements must end in under 3 years but can be renewed during the last 3 months for up to another 3 years. OMB must report to Congress each year on how well Do Not Pay reduced wrong payments and how often errors were fixed. OMB must also work with the Social Security Commissioner, states, and others to improve death data quality, aim for at least daily access, move to electronic reporting, find better ways to stop payments to deceased people, and report a plan plus any legislative ideas to Congress within 120 days.
