A notice to the person who may be liable must be mailed or delivered under section 3803(d)(1) no later than whichever is later: 6 years after the violation, or 3 years after the head of the agency knew or should have known the facts — but in any case not more than 10 years after the violation. A lawsuit to recover a penalty must start within 3 years after the liability decision is final. If, during these proceedings, the head of the agency learns of bribery, gratuities, a conflict of interest, or similar corruption tied to the false claim or statement, they must report it right away to the Attorney General and, if the agency has one by law, to its Inspector General.
