Pays a survivor annuity to the Comptroller General’s spouse or dependent children when the Comptroller General chose the plan under section 773, dies in office or while getting a retirement annuity, had at least 18 months of civilian service when they died, and had payroll deductions or deposits taken for the last 18 months of that service. “Allowable military service” means up to 5 years of honorable active military duty not used for another annuity. “Other prior allowable service” means prior civilian work for the federal or D.C. government not counted in the main service formula. “Congressional employee” is the same as the definition in 5 U.S.C. 2107. If only a spouse survives, the spouse gets an annuity that starts at the Comptroller General’s death or when the spouse turns 50, whichever is later. If a spouse and dependent child survive, the spouse gets an immediate annuity and each child gets an immediate payment equal to the smaller of 10% of the average annual pay or (20% of that pay divided by the number of children). If only dependent children survive, each child gets the smallest of: the spouse’s share divided by the number of children, 20% of the average annual pay, or (40% of that pay divided by the number of children). A surviving spouse’s annuity is computed as 1.5% of the average annual pay (based on the three highest years as Comptroller General and allowed prior service) times the years of service as Comptroller General or member of Congress and allowable military service (plus up to 15 years of congressional employee service), plus 0.75% of that average pay times years of other prior allowable service. The spouse’s annuity cannot be more than 50% or less than 25% of the average annual pay. If required deposits were not made, that service may still be credited unless the spouse declines, but the annuity is reduced by 10% of the unpaid deposit amount as of the date of death.
