Only certain government sewer agencies may get permits to dump or carry municipal sludge for dumping in the New York Bight Apex. Apex means the Atlantic Ocean area west of 73°30′ W longitude and north of 40°10′ N latitude. Apex site means the spot inside that area where municipal sludge was dumped before October 1, 1983. Eligible authority means a sewerage authority or other state/local government that, on November 2, 1983, had a court order allowing it to dump at that Apex site. The EPA Administrator must not issue or renew permits for dumping or transporting sludge into the Apex after the earlier of December 15, 1987, or the first day the Administrator finds eligible authorities can reasonably dump at a different site designated under section 1412. The Administrator also must not issue or renew any permit that lets anyone other than an eligible authority dump or transport municipal sludge to the site called the “106-Mile Ocean Waste Dump Site” (see 49 F.R. 19005).
