Last updated Apr 6, 2026|Official source

Summary

Make copies of any communication, document, report, or information sent between a federal official and anyone about a deepwater port available for the public to see and copy for a reasonable fee when a person asks, unless the material is protected by law or by the exceptions below. Contracts covered by section 1504(c)(2)(B) are not automatically released. The Secretary must not disclose trade secrets (see 18 U.S.C. 1905) or the contract in section 1504(c)(2)(B), but may share such confidential information in ways that keep it secret: with other federal or nearby coastal state agencies for official use, with congressional committees that oversee the topic, in a court case under a protective order, or with the public to protect health and safety after giving the affected party notice and a chance to comment in writing or to discuss the matter in closed session within fifteen days unless that delay would harm public health or safety.
