Breaking the MARPOL Protocol, Annex IV of the Antarctic Protocol, or the rules made under them is illegal. The Secretary must work with other countries that are parties to those Protocols to find and stop violations. The Secretary must use monitoring tools, set up ways to report problems, and gather evidence. When there is evidence of a violation, the Secretary must investigate. The Secretary can require witnesses and documents. If someone refuses, the Secretary can ask the Attorney General to get a court to require cooperation. The Secretary can inspect certain seagoing ships at U.S. ports, U.S.-flag ships, and ships under U.S. authority to check for illegal discharges, improper garbage disposal, or other pollution rule breaches. If an inspection or other information shows a violation, the Secretary can take enforcement actions required by the Protocols and other actions deemed appropriate. If another party provided the initial evidence, the Secretary, through the Secretary of State, will tell that party what action was taken or planned. The Administrator has the same powers as the Secretary to enforce regulations 17 and 18 of Annex VI for shore-based violations and for other matters the Secretary sends to the Administrator.
