§1962 Board of Directors of the Foundation

Title 33 › Chapter CHAPTER 33A— - MARINE DEBRIS RESEARCH, PREVENTION, AND REDUCTION › Subchapter SUBCHAPTER II— - MARINE DEBRIS FOUNDATION › § 1962

Last updated Apr 6, 2026|Official source

Summary

The Foundation must have a Board of Directors made up of the Under Secretary and 12 other U.S. citizens. The Board must include people with different views on assessing, preventing, reducing, and removing marine debris. The Board gives candidate recommendations to the Under Secretary. The Under Secretary, after consulting the EPA Administrator, the Director of the U.S. Fish and Wildlife Service, the Assistant Secretary of State for Oceans and International Environmental and Scientific Affairs, and the Administrator of USAID, and with the approval of the Secretary of Commerce, appoints the 12 directors. At least 4 must have education or experience with marine debris work (including things like post-consumer materials management or a circular economy), at least 2 must have experience with marine debris outside the United States, at least 2 must have ocean or coastal conservation science or policy experience, and at least 2 must have international trade or foreign policy experience. Directors serve 6-year terms, may serve no more than 2 consecutive full terms, and the Under Secretary fills vacancies with Commerce approval. Removal of a director requires consultation with the same officials and Commerce approval. Appointment does not count as U.S. government employment. The Board picks a Chair from its members for a 2-year term. A majority of members is needed to do business. The Board must meet at least once a year. Missing three regular meetings in a row can lead to removal. Board members are unpaid but can be paid back for travel and living expenses. The Board can set up the Foundation by hiring initial officers and employees, adopting bylaws, and taking other needed steps. Staff can only be hired if there is enough money to pay them, and these hires are not bound by usual federal hiring and pay rules. The first hire must be the Board Secretary, who will act as the chief executive officer and must know about marine debris. The Board hires and reviews the CEO and may remove them. The CEO hires, reviews, and may remove other staff.
