Within 180 days after December 16, 2016, the Secretary must issue guidance so that feasibility studies for water projects can count the full amount of in-kind credits from mitigation banks approved by the Secretary and from in-lieu fee programs whose approved service area includes where the project will have impacts. Those credits count as a reasonable planning option if the mitigation bank has an approved mitigation banking plan, has done a functional analysis using the Corps’ approved regional habitat assessment model, and the Secretary decides using them gives reasonable assurance the project’s legal mitigation requirements (including monitoring or showing mitigation success) will be met. This guidance does not change other laws or force or limit mitigation choices.
