The Secretary can take and use materials, services, or money given by a non‑Federal public entity, a nonprofit, or a private group to repair, restore, replace, or maintain a water resources project. The District Commander must first find that the project faces a risk to how it works for its approved purposes and that taking the donation is in the public interest. Anyone who gives materials or services cannot get credit or payback for their value. The used donations must meet the same laws and rules that would apply if the Secretary bought them. Donated services can only add to the work of Federal employees and may be used only for work that would not get done because of money or staff limits. By February 1 each year after the first fiscal year donations are accepted, the Secretary must send the Senate Committee on Environment and Public Works and the House Committee on Transportation and Infrastructure a report describing the activities, the costs, and why those activities were needed to keep the project safe and reliable.
