Lets the Secretary accept and use materials, services, and money from nonfederal groups or private organizations to fix or restore federal water projects in places where either a Governor asks for an emergency finding or there is a Stafford Act disaster declaration. The “emergency period” is the time the Secretary says an emergency exists or the time the Stafford Act declaration is in effect. The Secretary can pay back those contributors if the Secretary thinks it is in the public interest and money is available. Payment only happens if the materials or services meet the Secretary’s specs and follow all laws that would apply if the government bought them, including sections 3141–3148 and 3701–3708 of title 40, section 8302 of title 41, and the National Environmental Policy Act. Before giving anything, contributors must sign an agreement saying they will protect the United States from damages (unless the U.S. is at fault), certify legal compliance, and accept any other required terms. If contributions were made first, the contributor must later sign an agreement that sets the Secretary’s determined value for reimbursement and confirms the same protections and compliance.
