You must first bring any claim for cleanup costs or damage to the party or guarantor named under section 2714(a). There are exceptions that let you go straight to the Fund: if the President has put out a notice, if the claimant is a responsible party seeking reimbursement, if a State governor files for State cleanup costs, or if a U.S. claimant is harmed by oil from a foreign offshore unit the Fund covers. Claims won’t be approved by the Fund while the claimant is suing in court over the same costs. If the responsible parties deny the claim or do not pay within 90 days after the claim is filed (or after official advertising begins, if later), you may take the unpaid part of the claim to the Fund. You may also bring interim or partial claims for amounts not fully paid. The President must write rules for how claims are filed, handled, and decided.
