§2718 Relationship to other law

Title 33 › Chapter CHAPTER 40— - OIL POLLUTION › Subchapter SUBCHAPTER I— - OIL POLLUTION LIABILITY AND COMPENSATION › § 2718

Last updated Apr 6, 2026|Official source

Summary

States and local governments may set tougher rules or add extra responsibilities for oil spills and cleanup. The federal rules do not stop states from doing this, and they do not change anyone’s duties under federal or state waste laws or common law. States can create or keep funds to pay for oil pollution costs and can require people to put money into those funds. The United States, states, and local governments can still add liability, rules, fines, or penalties for violations. Also, you cannot use this law to start a personal lawsuit against a federal officer or employee for actions they took while doing their official job.
