Summary

When a commissioned corps officer is promoted, the officer is treated as accepting it on the date the President makes the promotion unless the officer says no. The officer must receive the higher pay and benefits from that date unless another law gives an earlier effective date. If the officer took the oath required by section 3331 of title 5 and has served without a break, they do not need to take the oath again on promotion.
