Summary

It is illegal to fish or dredge for shellfish in the channels going into or out of New York Harbor, or to do anything that blocks or makes those channels unsafe for large ocean ships and deep-draft vessels. Breaking this rule is a crime called a misdemeanor. A person convicted can be fined between $50 and $250, jailed for 30 days to 6 months, or both, as the judge decides. The United States harbor supervisor must enforce the rule. The supervisor’s inspectors can arrest people with or without a warrant, but they may only arrest without a warrant if they see the offense happen. Anyone arrested must be taken right away before a federal magistrate, judge, or court and handled like other federal crimes.
