Congress lets New York City close or build over rivers or waterways that lie entirely inside the city and do not link to other navigable U.S. waters, but only if New York State first authorizes the city to do it. The city must file the location and plans with, and get approval from, the Secretary of the Army and the Chief of Engineers before starting work. Any changes to approved plans need their prior approval too. The city is responsible for any damage to private property. The federal government can change or cancel this permission later and will not owe money to the city or property owners because of that.
