If a bridge owner willfully refuses to follow a lawful order from the Secretary under this part, the owner is treated as having committed a misdemeanor. On conviction, the owner can be fined up to $5,000, and each month the owner stays in default counts as a new offense and can lead to more fines. The Secretary may also remove the bridge and related work at the owner’s expense, and the United States may sue to recover those costs. Courts can force removal or compliance by injunction, mandamus, or other quick orders in any district where the bridge exists, and the Attorney General can start those court actions when the Secretary asks.
