If a State or a State-created public agency (like a reclamation, flood control, or drainage district) tries but cannot buy land or an easement needed for a Congress-approved river or harbor project so it can give that land to the United States for free, the Secretary of the Army may start court action to take the land in the name of the United States. The Attorney General must handle the case when the Secretary asks. The State or agency must pay all court costs and any money the court awards, and the Secretary can require a bond up front to guarantee payment.
